Pursuant to New York law and these Rules and Regulations, smoking is prohibited in any
part of the common areas of the building, including but not limited to the hallways, staircases,
landings, roof, cellar, and lobby. Smoking is permitted by unit owners only, and unit owner
guests, within units, provided that and in such manner as such smoking does not interfere with
the rights and comforts of other unit owners. Smoking by tenants or their guests within units,
limited common areas, or the building is prohibited pursuant to Section 4 herein, "Leases of
Units."
